Your use of the website and / or training services at www.lingoperfecto.com (‘the Site’) is governed by these terms & conditions of use, and by using this site you consent to these terms & conditions of use. You may print and keep a copy of these terms of use. The terms & conditions of use are a legal agreement between us and can only be modified with the prior written consent of Lingo Perfecto. Lingo Perfecto reserves the right to change the terms & conditions of use at its discretion by changing them on this webpage of the site.

If you wish to become a customer, communicate with other customers and / or make use of our services, you must read these terms & conditions and indicate your acceptance during the application process.

If you do not agree with any of the terms & conditions you should cease use of the site immediately.

Accuracy of information and disclaimer

Lingo Perfecto will within reasonable endeavours ensure that all information on the site is accurate. However, the information available on the site is provided for general information purposes only and is not intended to provide comprehensive information or guidance on the training or course subjects covered. Prior to entering into any contract based on or relating to information on this site, you should obtain full information from Lingo Perfecto. Lingo Perfecto is not responsible for information provided by any third party in relation to such a contract.

You acknowledge that any reliance upon any information or other material contained on this site is entirely at your own risk, undertakings, conditions and terms, expressed or implied, whether by common law, statute, custom, trade usage, course of dealings or otherwise (including without limitation as to quality, fitness for purpose, performance or suitability for purpose) in respect of the site are hereby excluded to the fullest extent permitted by law.

You acknowledge that we cannot guarantee that our site will always be available to you, owing to the nature of the internet. In addition, you acknowledge that our site may be unavailable owing to maintenance, but where possible we will perform such maintenance outside of operating hours, and we will aim to minimise the disruption period.

Code of conduct

You agree to ensure that all details which you submit to us via the site or e.mail are correct and to inform us promptly should any of the details which you have provided to us about you need to be changed or updated.

If accessing any part of our site that requires you to enter a password you agree to keep any personal login name and password details for use on the site confidential, and to be responsible for any loss or damage resulting from use of your password by any third party.

Lingo Perfecto reserve the right to terminate your access to password-protected areas of our site or services should we consider that your use of the site or services is detrimental to the site or to other users or representatives.

When accessing the site you agree:

not to use the site in such a way that disrupts, interferes with or restricts the use of the site by other third party users;

to ensure that any materials uploaded, displayed or transmitted by you through or to the site, during lessons or sent via e.mail are not false, offensive, defamatory, threatening, obscene, unlawful and do not breach or infringe the rights of any person anywhere in the world and you waive any moral rights in respect of any such materials;

not to copy or adapt any software or other code or scripts forming part of the site nor attempt to transmit to or via the site any information that contains a virus, worm, trojan horse, malware or other harmful or disruptive components;

not to send ‘spam’ email or any unsolicited correspondence which is unrelated to the business of Lingo Perfecto to any addresses made available on the site;

not to change, alter, delete, interfere with or misuse information contained on the site entered by or relating to any third party user of the site.

Should Lingo Perfecto suffer loss owing to a breach by you of these terms & conditions, you agree to compensate us for any such loss.

You should ensure that you have proper protection against computer viruses, malware, worms, trojan horses or other items of a destructive nature whilst using the internet, and that your connection to the site is secure.

Links and message boards

The site may include hypertext links to third party websites. Lingo Perfecto accepts no responsibility for the content or availability of any third party site.

Any opinions posted on message boards or forums forming part of this site are not necessarily those of Lingo Perfecto, or anyone connected with Lingo Perfecto. We reserve the right to edit or delete any postings to forums or message boards at our sole discretion, but have no obligation to monitor or amend the content of such message boards.

Course fees

In order to access site features and services you are required to register with Lingo Perfecto. Information collected during the registration process and information related to your enrolment will be subject to the ‘terms & conditions’ and our ‘data protection’ policy. You solely represent your account and warrant that you will not enrol on behalf of anyone other than yourself, that all information provided is true, accurate and complete, and that you will maintain, at all times, true, accurate and complete information related to your account.

Training services are available only through the purchase of an online English course. In accordance with this agreement you are obliged to pay any fees associated with services offered on this site. Lingo Perfecto course fees will incur an annual increase in charges and will be duly posted on the site and emailed to all customers and stakeholders.

By enrolling onto a training course you agree to the terms & conditions on this site.

Payments and billing

Lingo Perfecto enrolment fees do not include any applicable VAT or taxes, interest or instalment fees charged by credit / debit card companies, or other fees associated with using to the Internet.

We ensure you that all credit / debit card transactions made with Lingo Perfecto are safe and secure. If in doubt you may check on the status of your application by contacting Lingo Perfecto via email: info@lingoperfecto.com

You will find your course fees under language courses on checkout pages and occasionally on other pages of the site. The exact contents of your language course are available and accessible at all times in the logged-in section of the Site under ‘My account’.

All English language training course fees are on a recurring basis and are non-refundable after your purchase. If you do not cancel your enrolment before the end date of your course, you agree to the automatic renewal of your English language training course enrolment for the same period and under the same terms & conditions. If you would like to cancel your enrolment, you should delete your account on the ‘My Account’ page in your login area or send an e.mail to: study@lingoperfecto.com

An exception to the above is our 7-day free trial money-back guarantee. Within 7 days after successful enrolment onto your first monthly subscription, you have the option cancel your enrolment and receive a full refund, by sending a written request within the 7 day period to: study@lingoperfecto.com

If your credit / debit card expires, is invalid, lost, or stolen, your enrolment is in jeopardy of cancellation. We will inform you and give you the opportunity to change or update your registration details. If your credit / debit card is not successfully recharged and you are not renewed successfully, your enrolment will be cancelled.

Enrolment

Enrolments should be made at least 7 days in advance of your intended course start date and payment must be cleared in our account. Course fees must be paid in full before the course start date. If we cannot accept your application, we will offer you an alternative or refund your course enrolment fees. 

Age limit

The minimum age at Liverpool English Centre is 14 years (Parental consent is required for students aged under 18 in written format). There is no maximum age limit.

Applicants with disabilities or special needs

If you have any mental or physical illness, allergy, disability or condition that may interfere with your ability to successfully complete your course of study, we request that you tell us when booking a course so that we can advise you on the suitability of the course and any reasonable additional support we may be able to offer.

Level / progress tests & course levels

There are differences between the entry level test and course progress tests in levels of subject knowledge and difficulty and when they are delivered. When you apply, you will take an entry level test and according to the result your level will be determined and you will be placed on a suitable course.

Courses run on a continuous enrolment cycle and therefore you may join a course at the beginning or near the end. There is a mid-course test after 75 hours and an end-of-course progress test after 150 hours from the course start dates. In order to progress to a higher level you must score 70%.

If you do not score 70% you will be required to remain in the same level. If you do score 70% you will move up a level. If you feel you are in the wrong level or if you fail to reach 70% on an end-of-course test you will be given an opportunity to take a level-up test at your teacher’s discretion.

Several courses require minimum levels of English for entry. If after enrolment, you are found to be below the minimum level required to start the course, Lingo Perfecto reserves the right to place you in a different class at a lower or higher level and with fewer or more classes.

If you are not sure of your level of English, please contact us before booking. We reserve the right to determine the best course of study for any student. Your progress will be monitored by your teacher and you will be moved levels where appropriate. 

Exit test

Should you leave your course before the end-of-course progress test you may take an exit test to determine how much progress you have made since your course start date.

Course changes

In cases where a course is rescheduled by Lingo Perfecto prior to the start of the first lesson and the new time or date is unacceptable to the student, all fees will be refunded.

Lingo Perfecto is not liable for any damage, loss, illness or injury to persons or property, however caused and will not be held liable for any delays in scheduled services offered by third party companies.

If you want to change / postpone the dates you have booked, we must receive written notice at least 1 week before you are due to begin. Lingo Perfecto reserves the right to charge an administration fee each time course changes are made after an enrolment application has been confirmed. 

Holidays, absences and lateness

We expect all students to attend every lesson and start on time (teachers will wait up to 30 minutes for non-arrivals) otherwise you may not gain access to your lesson. 

If you are absent from a lesson, regardless of the reason, we cannot give you a refund or allow you to take the lesson at some other time. If you begin your course late no refund will be made for the time missed.

You may not receive a leaving certificate unless you attend a minimum of 80% of your course. 

Public holidays

Classes are not held on public holidays. If the Monday is a public holiday, course start dates will fall on a Tuesday. Compensation will be offered for classes not delivered on public holidays in the form of a replacement class which will be included in your invoice . 

Liability

Lingo Perfecto does not accept liability for losses or additional expenses you might incur because of cancellation or delays of your services.

Lingo Perfecto is not liable for failure to perform its obligations if the failure is because of external events not under the school’s control (e.g. war, terrorist activities, natural disasters, earthquakes, hurricanes, infectious diseases, pandemics, labour dispute, failure of electricity or water supply etc.), provided the school can prove it took reasonable steps to minimise delay or damages caused by foreseeable events.

Photography, filming and sound recording

Lingo Perfecto may  use photographs, video film footage or audio recordings of students for promotional purposes, both printed and online. Any student who does not wish to participate should inform us at the time of enrolment or state at the time of the photographing or video filming that they wish not to participate. By accepting these terms and conditions the student gives consent to the use of these photographs or video footage without further consent or notification. 

Services

Lingo Perfecto reserves the right to change details of its services, including courses, facilities,  and course dates, where circumstances beyond the company’s control necessitate such changes or where the number of enrolments is not enough to operate a course viably.

Lingo Perfecto reserves the right to change course curricula or replace teachers at any time during the course. New course schedules may be issued upon completion of each course level.

Complaints

If you are unhappy with any aspect of our services then please speak to your us immediately. We will try to resolve the problem as quickly as possible. We will investigate the complaint fully, provided it has been received before the end of your course and all invoices have been paid in full. All disputes are handled under UK law. 

Refund policy

After the course starts there is no refund except in exceptional cases. If you have booked a course at Lingo Perfecto through an agent you must first contact the agent. The agent will then contact us on your behalf.

Course and services cancellation refund requests must be made in writing. Failure to provide written notification may incur charges.

No refunds will be provided if fraudulent documents are submitted as part of a course application; if the student is expelled from Lingo Perfecto;
if the student provides less than one week’s notice to cancel.

Refunds are given if Lingo Perfecto cancels a course. Where a refund has been agreed we will only make the refund payment to the person who originally paid by bank transfer. Any refund requested to be made to a non-UK based account will incur international transfer fees. These transfer fees must be met by the person requesting the refund. 

Refund requests that do not comply with our terms & conditions will be rejected.

Governing law and jurisdiction

The terms & conditions shall be governed by and construed in accordance with English law. Each party irrevocably agrees to submit to the non-exclusive jurisdiction of the courts of England over any claim or matter arising under or in connection with the terms & conditions.
